Please read these Terms of Service ("Terms") carefully before using the Nudge Deck app and website (the "Service") operated by James Shah ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Nudge Deck.

1. The Service

Nudge Deck is a playful couples game for iOS that lets paired partners send each other Nudges — challenges, dares, questions, and things to do together — respond with proof, stack or counter Nudges, pass, and review a season recap.

2. Eligibility

You must be at least 17 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. The Service is intended for adults using it with a consenting partner. You are responsible for complying with local laws.

3. Accounts

You sign in with Apple to create and access your account. You are responsible for activity under your account and for keeping your Apple ID secure. Provide accurate information and notify us if you believe your account has been compromised.

4. Pairing and Intended Use

Nudge Deck is designed for one paired couple at a time. You agree to use the Service respectfully with your partner and not to harass, coerce, or pressure anyone into pairing, completing Nudges, or sharing proof.

5. User-Generated Content

You may submit content through the Service, including custom Nudges, notes, photos, and voice notes ("Content"). You retain ownership of your Content. By submitting Content, you grant us a limited license to host, store, process, and display it as needed to operate the Service for you and your paired partner.

You agree that:

• You are solely responsible for Content you submit.
• You will not submit Content that is illegal, exploitative, hateful, threatening, harassing, sexually explicit involving minors, or otherwise inappropriate.
• You have the rights needed to submit any Content you upload, including photos and voice notes featuring other people.
• Proof and couple activity are visible to your paired partner by design.

6. Prohibited Conduct

You agree not to:

• Use the Service to spam, harass, stalk, or abuse anyone
• Impersonate another person or misrepresent your identity
• Attempt to access another user's account, couple data, or proof without authorization
• Reverse-engineer, scrape, or interfere with the Service
• Use the Service for any unlawful purpose or in violation of these Terms

7. Push Notifications and Quiet Hours

If you enable notifications, we may send push alerts about Nudges and related activity. Quiet hours may delay delivery, but you remain responsible for how you and your partner use the Service.

8. Termination

We may suspend or terminate access to the Service if you violate these Terms, misuse the Service, or create risk for other users or for us. You may stop using the Service at any time and request account deletion by emailing [email protected].

9. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim or (b) USD $50.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your Content, your use of the Service, or your violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and may provide notice in the app or on this website. Continued use after changes become effective constitutes acceptance of the updated Terms.
